The Code of Criminal Procedure, however, 814 - 819, provides that when a person has been convicted of treason, and has escaped and cannot be found, judgment of outlawry may, after certain proceedings, be rendered, and the defendant shall thereupon for feit to the State during his life, but no longer, all his property, real and personal.
These two statutes, when construed together, are to be deemed to have been enacted on the same day (jan. 4, (see Penal Code, 727, as amended, L. 1882, ch. 102; Code Crim. Proc., They are therefore to be construed together as establishing a general rule with one exception.
