The term practice is usually employed as excluding both plead ing and evidence, and to designate all the incidental acts and steps in the course of bringing matters pleaded to trial and proof, and procuring and enforcing judgment on them. As applied to crim inal procedure, the term includes the rules which direct the course of the proceedings by which the accused is brought before the court, the conduct of the trial, and the proceedings after trial.
