According to the European foundation of property in land possessed by the Indians, discovery alone, without conquest, gave the government the right of pre-eminent domain, and the Indians had only the right of occu pancy. The Indians could not dispose of these lands, and no person had a right to purchase of them without the consent of the government. The above principles were recognized by all the European governments that made discoveries upon this continent.
