This book charts the historical development of laws and legal systems through the use of comparative jurisprudence, examining Jewish legal history as a unique example of the patterns of legal change that exist across the globe. Starting from the idea that the Biblical canon was never fully closed to interpretation and that the laws within were not treated as static, the study considers the evolution of Jewish law across three distinct cycles, each characterised by either literalism, equity, or legislation. In doing so, the author suggests that there is an inevitably cyclical nature to legal systems, where strict adherence to the original text of the law eventually gives way to a more flexible interpretation based on principles of equity before new laws are introduced to codify the changes and innovations that have occurred over time. This unique study on Jewish jurisprudence opens up new avenues for researchers and those interested in comparative law, providing a framework of analysis that can be applied to other legal systems.

To recapitulate: of scientific studies of the whole of Jewish law (biblical, Talmudic and post-talmudic) there are none always excepting the necessarily eclectic articles in cyclopedias; of monographs there are a considerable number: good, bad and indifferent, adding stone after stone to the edifice; while a sur vey of the whole field in the light of comparative jurisprudence seems never to have been attempted.
