Duke Of Buckingham, being attainted of high trea son, Anno 13 Hen. VIII, the office became forfeited to the crown, and was never afterwards granted, but to be exercised at a coronation. Says Gwyn, the court Of the Constable and Marshall deter~ mineth contracts touching deeds of arms out of the realm upon land, and handleth things concerning war within the realm, as combats, blasons of armory, &c., which cannot be determined by the common law; and in these matters is commonly guided by the civil law. The power and juris diction originally held by the constables were limite'd and restricted by repeated acts Of parlia ment until they became mere ministerial Officers with powers similar to those they now possess.
