It is now urged that it was' error in the learned Judge, at the trial, in not advising the jury there was no sufficient evi dence of premeditation to warrant a verdict of murder in the first degree. It is a sufficient answer to this objection to say that no such request was made at the trial, and, consequently, no refusal and exception.
