Produced by the Institute of Medicine's Committee on Health Research and the Privacy of Health Information, this report assesses whether the HIPAA Privacy Rule is having an impact on the conduct of health research and proposes recommendations to facilitate the efficient and effective conduct of important health research while maintaining or strengthening the privacy protections of personally identifiable health information. The Committee concludes that the HIPAA Privacy Rule does not protect privacy as well as it should and that, as currently implemented, it impedes important health research. The Committee recommends that Congress authorize the U.S. Dept. of Health and Human Services (HHS) and other relevant federal agencies to develop a new approach to protecting privacy in all health research, that HHS should revise the Privacy Rule and associated guidance, and additional related changes be implemented to facilitate these two main policy revisions.
