La même observation s'applique aux mots action criminelle, qui désignent aussi bien les poursuites correctionnelles que les poursuites criminelles proprement dites. En effet, lorsqu'on a rédigé le Code civil, on n'était pas encore fixé sur la terminologie adoptée et consacrée depuis par les Codes d'instruction criminelle et pénal.
