Judicial Notice a Rule Of Evidence. Where complainant filed a bill to secure her interest in land, and alleged the sale of it to defendant under a decree Of the probate court was invalid because the debts Of which it was sold were barred as against intestate, the contention that the probate court judicially knew that the administration Of the estate had been pending for a sufficient time to bar all debts against the intestate was without merit, since judicial notice is a rule Of evidence and can have no bearing on the acquirement Of jurisdiction by a court on the filing Of a petition.
