The early cases in the United States are in great conflict and conqion dpe perhaps to vague concepts of the meanings of restraint of trade and injury to the public interest and the application of these concepts under vandng circumstances. Some courts condemned price fixing agreements merely because competition between the parties Was suppressed. Other courts said such agreements were void per se without rega,rd to whether they were monopolistic in intent or effect. Some courts relied on the fact that freedom of action of the parties was restiicted. And the fact that monopolistic power was obtained by the parties. A few courts enforced these agreements where the prices fixed were reasonaole to the publ1c and pioper for the parties on the ground that par tial restraints were valid if reasonable and not injurious to the public. Some courts said these agreements were enforcible if no men opolistic power was involved. In England. The courts in modern times have upheld piice fixing agreements. If reasonable as between the par ties, unless it was shown that they would, or were calculated to, produce a real monopoly or enhance prices to an unreasonable extent.
