Now what could the plain, old fashioned common law, with its quaint discussions of the king's highway and the duties of common carriers do with that masterful banditti. I tell you the inter-state Commission with its summary powers wasn't created a moment too soon. Dangerous diseases require trenchant rem edies, and despotic institutions must be dealt with by despotic measures. True, much can be accomplished with the old laws with their interpretation and enforcement in the hands of fearless and progressive judges, as the man whose name we all honor and Jay Gould execrates has demonstrated in the Wabash controversy. But such judges could do vastly more if supplemented by com petent and honest legislators.
