In three other cases which I tried at the last December term, the saving would have been $150.00. Besides saving of expense, great convenience if parties could return at night. This delay cannot be safely avoided. The judges are reluctant to assign cases because of inconvenience to other parties. I received notice last night that a motion would come up in the morning, and was obliged to start in the evening for Worcester--These evils have had the effect of compelling arbitration. The inconveniences have occasioned it-- A party of moderate means does not feel like engaging in litigation because of inconveniences. 1 have advised references, and have frequently stated in relation to claims under $100.00 the effect of litigating. I have tried cases in Franklin Court House: The Court House there is entirely adequate to the necessities of the bar, and is regarded so. Expense of it, $16,000. Same inconvenience in all cases in all courts at Worcester. Frequent inconvenience in searching records and attending Probate Courts. Litigated cases in Probate Court, must be tried at Worcester. Has been a division of actions for several years past,--in effect a division of the County. The rule was adopted on account of the distance of parties. Our list was assigned last term to commence on the 10th of January. Mr. Wood had a large number of witnesses there at that time.
