The Gradual Convergence: Foreign Ideas, Foreign Influences and English Law on the Eve of the 21st Century - Hardcover

9780198258285: The Gradual Convergence: Foreign Ideas, Foreign Influences and English Law on the Eve of the 21st Century

Inhaltsangabe

A collection of papers using mostly comparative methods, this book discusses topical issues from the areas of contract and torts, crime and criminal procedure, international conventions, human rights and environmental law, and suggests that the move towards European unity, despite its ups and downs, is proceeding apace, even though unity does not (and need not) imply uniformity. Noticeable, too, is the marked convergence of solutions and techniques, prompted by the similarity of problems which confront member states, and the growing influence, direct and indirect, of the two European Courts upon their national law. This book, both in its descriptive and prescriptive aspects, should provide food for thought for both students and practitioners interested in foreign law, comparative law and methodology, law reform and European law in general. Basil Markesinis is the author of the second edition of "Tort Law" (with R.W.M. Dias).
