Greenleaf [1783-1853] was Dane Professor at Harvard Law School during its formative period. An expert on evidence, his most important publication is his three-volume Treatise on the Law of Evidence [1842-1853], the standard textbook in American law throughout the Nineteenth century. Along with Joseph Story, he is responsible for the emergence of Harvard Law School and played an important role in the establishment of modern American legal scholarship. The Testimony of the Evangelists combines his juridical expertise and profound Christian faith. A fascinating work grounded in an impressive command of sources, it is also a landmark in the development of juridical apologetics, the defense of faith through legal reasoning.

First published between 1842 and 1853, Greenleaf's was the first important American treatise on evidence and the standard work for nearly half a century. John H. Wigmore edited this edition when he was writing his own great treatise on this subject. It marks the transition from Greenleaf on Evidence to Wigmore on Evidence. "Until the appearance of Professor Greenleaf's Treatise upon Evidence, the Bar in the United States was wholly dependent upon English works for information in this department of the law." J.G. MARVIN, Legal Bibliography (1847) 347-348, citing earlier eds. SIMON GREENLEAF [1783-1853] was a lawyer and law professor who succeeded Joseph Story as Dane Professor of Law at Harvard University. In addition to his treatise on evidence, he was the author of The Testimony of the Evangelists Examined by the Rules of Evidence Administered in Courts of Justice (1874) and a revision of William Cruise's A Digest of the Law of Real Property (1849). JOHN HENRY WIGMORE [1863-1943] was educated at Harvard University and Harvard Law School. After a period of private practice in Boston, he was recruited as a legal advisor to the Japanese government and assigned to teach law at Tokyo's Keio University from1889 through 1892. He returned to the United States in 1893 to join the faculty of Northwestern University Law School, where he spent the rest of his professional career. He was a prolific author. In addition to his scholarship on evidence, Wigmore edited several volumes of historical Japanese legal documents and published notable works on comparative and international law.

Little & James Brown, 1842. xlviii, 658 pp. Octavo (9" x 6"). Contemporary sheep, blind fillets to boards, lettering piece and raised bands to spine. Greenleaf succeeded Joseph Story as Dane Professor of Law at Harvard and played a leading role in the development of its law school. His seminal treatise on evidence was the first important American work on the topic. It was originally issued as a one-volume work devoted to general principles of evidence. Greenleaf published a second volume in 1846 on particular cases of evidence and a third volume on criminal evidence and pleading in 1853. These two books were given volume designations. All three were then re-issued with a revised Volume I in 1853 as the second edition. From that edition onward, Greenleaf on Evidence remained a three-volume work. As indicated on the versos of their title pages, the English and American editions were printed in Cambridge, Massachusetts by Torry and Ballou. Other than the order of the publishers on the title page, both editions are identical. Not in Sweet & Maxwell.

His 1846 work The Testimony of the Evangelists was a landmark in the development of juridical apologetics, the defense of faith through legal reasoning. He was also the president of the Massachusetts Bible Society for a number of years. In this letter, he writes to Charles T. Russell [1815-1896], a Harvard Law School alumnus and fellow lawyer, in advance of a meeting of the Society which he could not attend and asks Russell to help him gain support for a recommendation. The letter reads, in part: "I fear I shall not be able to attend the Trustees' meeting tomorrow, & therefore inclose our report to you. Please get Dr. Parkman to sign it, if acceptable to him, & let it be offered. I hope Dr. P. will attend the meeting, & as he will preside, it will be important for you to be there, & explain our views." Dr. Parkman was likely the Rev. Francis Parkman, Sr. [1788-1853].
